(“Company”, “we”, “us”, or “our”) collects and uses the personal information you provide to us on our website and all other websites, mobile sites, applications, platforms and tools where this Privacy Policy appears or is linked, and through the use of our services, (collectively the “Site”). It also describes the choices available to you regarding our use of your personal information and how you can access and update this information.

Cookies are small text files of information stored by the Internet browser on your computer’s hard drive. Our cookies do not collect personal or confidential information and are not spyware.

  • Unclassified – These are cookies that have not yet been categorized. We are in the process of classifying these cookies with the help of their providers.

Web Beacons

Our Site contains electronic images known as web beacons (sometimes called single-pixel gifs) and are used along with cookies to compile aggregated statistics to analyze how our Site is used and may be used in some of our emails to let us know which emails and links have been opened by recipients. This allows us to gauge the effectiveness of our customer communications and marketing campaigns. We use a third party to gather information about how you and others use our Site. For example, we will know how many users access a specific page and which links they clicked on. We use this aggregated information to understand and optimize how our Site is used.

However, in a few cases, some of our Site features may not function as a result. Essential cookies cannot be rejected, as they are strictly necessary to provide you with our Site.

3.     Do Not Track

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. We do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online.

4.     Promotional Communications.

We may use your personal information to send you updates (by email, text message, telephone or post) about our products and services, including exclusive offers, promotions or new products or services.

We have a legitimate interest in processing your personal information for promotional purposes (see below “How and why we use your personal information”). This means we do not usually need your consent to send you promotional communications. However, where consent is needed, we will ask for this consent separately and clearly.

We will always treat your personal information with the utmost respect and never sell or share it with other organizations for third party marketing purposes.

5.     How Your Personal Information is Collected.

We collect most of this personal information directly from you — in person, by telephone, text or email and/or via our Site. However, we may also collect information:

  • Directly from a third party (e.g., business contact information which we import from a customer relationship management system for marketing and sales purposes);
  • From a third party with your consent;

7.     Who We Share Your Personal Information With.

We routinely share personal information with:

  • Our affiliates and subsidiaries. We disclose your personal information to other entities within our family of brands to fulfill any purpose described in this Privacy Policy.
  • Our Business Partners. We disclose your personal information to other companies with whom we partner to provide the Site and our services, to promote our products, services, offers, contests, or other promotions to our customers, and carry out other activities described in this Privacy Policy.
  • Our Service Providers. We disclose your personal information to third parties that provide business, professional, or technical support services to us and/or administer activities on our behalf.
  • Our Analytics Providers. We disclose your personal information to parties that assist us in performing analytics and help us measure the effectiveness of the Site and our marketing and advertising efforts.
  • Our Marketing and Advertising Partners. We disclose your personal information to our marketing and advertising partners, including social media networks, third-party advertising networks, and other parties that assist us in serving, measuring the performance of, and optimizing our advertisements.

By doing so, you authorize us to facilitate this sharing of information, and you understand that this sharing is governed by the social media site’s privacy policy that you used to log into your account.
  • Governmental and Public Authorities. We disclose your personal information to government and public authorities as necessary or permitted by the laws of any jurisdiction in which we operate, including in response to a subpoena, court order, investigative demand, request for cooperation from a law enforcement agency, or similar request from a self-regulatory body or government agency.
  • Relevant Third Parties in Connection with a Business Transaction. We may disclose or otherwise transfer your personal information to an acquirer, successor, or assignee as part of any merger, acquisition, debt financing, sale of assets, or similar transaction as well as in the event of any insolvency, bankruptcy, or receivership in which information is transferred to one or more third parties as one of our business assets.

We only allow our service providers to handle your personal information if we are satisfied they take appropriate measures to protect your personal information. We also impose contractual obligations on service providers relating to ensure they can only use your personal information to provide services to us and to you. We may also share personal information with external auditors, e.g. in relation to ISO accreditation and the audit of our accounts.

We may also need to share some personal information with other parties to the extent we believe it is necessary or appropriate to (1) protect our operations and those of our affiliates and subsidiaries; (2) investigate and prevent against fraud and other illegal activity; (3) protect our rights, privacy, safety, property, and/or those of others; or (4) allow us to pursue available remedies or limit damages that we may sustain.

We may disclose your personal information for other reasons described at the time of information collection or prior to disclosing your information. Additionally, we may disclose your personal information with your consent or when you direct us to do so.

Except as set forth above, we will not share your personal information with any other third party.

8.     How Long Your Personal Information Will Be Kept.

We will keep your personal information while you have an account with us or while we are providing our products and services to you. Thereafter, we will keep your personal information for as long as is necessary:

  • To respond to any questions, complaints or claims made by you or on your behalf;
  • To show that we treated you fairly;
  • To improve our security or detect and prevent fraud; or
  • To comply with legal or regulatory obligations or to keep records required by law.

We will not retain your personal information for longer than necessary for the purposes set out in this Privacy Policy. Different retention periods apply for different types of personal information. 9.     Children and our Site.

10.  Keeping Your Personal Information Secure.

We use reasonable and appropriate physical, technical, and administrative safeguards to protect your information from unauthorized use, access, loss, misuse, alteration, or destruction. We endeavor to protect the personal information we receive, gather and store, by such means as password protection, firewalls and other means. We limit access to your personal information to those who have a genuine business need to access it. Those processing your information will do so only in an authorized manner and are subject to a duty of confidentiality. We also require that third party service providers acting on our behalf or with whom we share your information also provide appropriate security measures in accordance with industry standards. We also have procedures in place to deal with any suspected data security breach. We will notify you and any applicable regulator of a suspected data security breach where we are legally required to do so.

Transmissions over the internet are never entirely secure and we cannot guarantee the security of information you submit via our Site while it is in transit over the internet. Any such transmission of information by you over the internet is at your own risk.

Information may be held at our offices and those of third party agencies, service providers, representatives and agents as described above (see above: “Who We Share Your Personal Information with”).

12.  A Note to Users Outside of the United States.

Company is headquartered in the United States and utilizes service providers in the United States and (solely with respect to sales and marketing information) Germany and Isreal. The Site is not intended for Site visitors outside the United States, Mexico, Australia, or Canada. If you are a non-U.S. user of the Site, by visiting the Site and providing us with data, you acknowledge and agree that your personal information may be processed for the purposes identified in this Privacy Policy. If you choose to access our Site outside the United States, Company and our service providers may transfer your personal information to, or access it in, jurisdictions that may not provide equivalent levels of data protection as your home jurisdiction. In particular, you are advised that the United States uses a sectoral model of privacy protection that relies on a mix of legislation, governmental regulation, and self-regulation. Where the laws of your country allow you to do so, by using the Site or the services or by providing your data, you consent and authorize Company to transfer, store, and use all such personal information in the United States (and any other country where we operate) which may not offer an equivalent level of protection to that required in the country where you reside and to the processing of that personal information by us on our servers located in the United States, as described in this Privacy Policy.   • You have a right to know how your Personal Information will be used. We will explain why we need your Personal Information before or when we collect it, if the purpose is not already clear.

  • We will not use or disclose your Personal Data other than for the purposes for which it was collected unless we receive your consent or unless we are required or permitted to by law.
  • We will keep your Personal Information only for as long as necessary for the purposes identified in our Privacy Policy, as required by law, or as necessary to resolve any disputes you may have concerning our Portal or Services. We will follow internally set guidelines and use care in the disposal, destruction, or de-identification of Personal Information to prevent unauthorized parties from gaining access to such Personal Information.

14.  Your Rights under the Privacy Act 1988 and the Australian Privacy Principles.

In Australia, you have certain rights under applicable data protection laws:

  • You have the right to access your personal information. We will not charge you a fee for your access request, but we may recover from you our reasonable costs of supplying you with access to this information. In some circumstances, it may not be possible for us to provide you with all of your personal information, or an exception to access under the Privacy Act may apply. For example, we may not be able to give you access if it would unreasonably affect someone else’s privacy. If we do not provide access to the personal information held about you, we will tell you why.
  • You also have the right to correct any personal information we hold about you that you think is inaccurate. We will take reasonable steps to make sure that the information is corrected. We reserve the right to refuse to correct your personal information in some circumstances. If we refuse to correct any personal information about you, and we cannot reach a subsequent agreement, you may request that a note or statement regarding the correct request be attached to the file that contains your personal information.

We will acknowledge your complaint and respond to you regarding your complaint within a reasonable period of time. If you are unhappy with our response to your complaint, please let us know and we will provide you with information about the further steps you can take. Please note that depending on where you reside, you may be restricted on the number of data access or data portability disclosures you may make within a 12-month period.

If you choose to contact us, we will take steps to verify your identity before granting you access to your personal information or complying with your request. In order to help protect your privacy and maintain security, you will need to provide us with:

  • Enough information to identify you (e.g., your full name, address, email address, or customer or matter reference number);
  • Proof of your identity and, to the extent the data is related to your employment, your employment status (e.g., a copy of your driving license and a certified letter signed by an officer of  your employer permitting you to make such requests); and
  • A description of what right you want to exercise and the information to which your request relates.

In addition, if you ask us to provide you with specific pieces of personal information, we may require you to sign a declaration under penalty of perjury that you are the consumer whose personal information is the subject of the request.

You may use a representative, called an "authorized agent," to submit a request to us. In order to protect your privacy, Company requires you to confirm that you have provided the authorized agent permission to submit the request and you must provide the authorized agent with signed permission. "Signed" means that the written attestation, declaration, or permission has either been physically signed or provided electronically pursuant to the Uniform Electronic Transactions Act.  

Company may deny a request from an authorized agent that does not submit proof that they have been authorized to act on your behalf. Requests submitted by an authorized agent will still require verification of the person who is the subject of the request in accordance with the process described above.

We are not obligated to make a data access or data portability disclosure if we cannot verify that the person making the request is the person about whom we collected information, or is someone authorized to act on such person’s behalf.

Any personal information we collect from you to verify your identity in connection with you request will be used solely for the purposes of verification.

If, in your interactions with the Site, you are linked or directed to, or click on, a third party website, we cannot control what information you may provide to that party or on that website, and we are not responsible for how that party may use or disclose any information you may provide to them. (“we” or “us” or “our”) collects about individual persons accessing our website (each a "user" or "you") at gosteelhead.com or app.gosteelhead.com (collectively with any other websites that we operate, including but not limited to any mobile website or mobile application related or connected thereto, and all related web pages, the “Site”) and our various software and service offerings as described on the Site (collectively with the Site, the “Service”). 

This Policy Is also intended to explain the conditions under which we use and disclose that information, and your rights in relation to that information. Changes to this Policy are discussed at the end of this document. Each time you use the Site, however, the current version of this Policy will apply. Accordingly, each time you use the Site you should check the Effective Date of this Policy (which appears at the beginning of this document) and review any changes since the last time you used the Site.

  • Users of the Site:

    Generally “Non-Personally-Identifying Information” is information that, without the aid of additional information, cannot be directly associated with a specific person. “Personally-Identifying Information,” by contrast, is information such as a name or email address that, without more, can be directly associated with a specific person. Like most website operators, we gather from users of the Site, Non-Personally-Identifying Information of the sort that web browsers, depending on their settings, may make available.   • Web Beacons:

    A “Web Beacon” is an object that is embedded in a web page or email that is usually invisible to the user and allows website operators to check whether a user has viewed a particular web page or an email. We may use Web Beacons on the Site and in emails to users of the Site to count users who have visited particular pages, viewed emails and to deliver co-branded services. Web Beacons are not used to access users’ Personally-Identifying Information. They are a technique we may use to compile aggregated statistics about Site usage. Web Beacons collect only a limited set of information, including a Web Cookie number, time and date of a page or email view and a description of the page or email on which the Web Beacon resides.     We may share aggregated and Non-Personally Identifying Information we collect under any of the above circumstances. We may also share it with third parties and our affiliate companies to develop and deliver targeted advertising on the Site and on websites of third parties. We may combine Non-Personally Identifying Information we collect with additional Non-Personally Identifying Information collected from other sources. We also may share aggregated information with third parties, including advisors, advertisers and investors, for the purpose of conducting general business analysis. For example, we may tell our advertisers the number of visitors to the Site and the most popular features or services accessed.   • Mobile Device Additional Terms on Mobile Device: 

    If you use a mobile device to access the Site or download any of our applications, we may collect device information (such as your mobile device ID, model and manufacturer), operating system, version information and IP address. o Geo-Location Information. Unless we have received your prior consent, we do not access or track any location-based information from your mobile device at any time while downloading or using our mobile application or our Service, except that it may be possible for us to determine from an IP address the geographic location of your point of connectivity, in which case we may gather and use such general location data. o Push Notifications. We send you push notifications if you choose to receive them, letting you know when someone has sent you a message or for other service-related matters. If you wish to opt-out from receiving these types of communications, you may turn them off in your device’s settings. o Mobile Analytics. 

    We use mobile analytics software to allow us to better understand the functionality of our mobile software on your phone. This software may record information, such as how often you use the application, the events that occur within the application, aggregated usage, performance data and where the application was downloaded from. We do not link the information we store within the analytics software to any Personally-Identifying Information you submit within the mobile application. SOCIAL MEDIA We may provide you the option to connect your account on the Site to your account on some social networking sites for the purpose of logging in, uploading information or enabling certain features on the Site. When logging in using your social network credentials, we may collect the Personally-Identifying Information you have made publicly available on the social networking site, such as your name, profile picture, cover photo, username, gender, friends network, age range, locale, friend list and any other information you have made public. Once connected, other users may also be able to see information about your social network, such as the size of your network and your friends, including common friends. By connecting your account on the Site to your account on any social networking site, you hereby consent to the continuous release of information about you to us. We will not send any of your account information to the connected social networking site without first disclosing that to you. 

    Each social network may further allow you to set privacy controls around your information on their system, and our collection of information will always follow such controls and permissions. This feature is subject to continuous change and improvement by us and each social networking site involved, and therefore the available features and shared information are subject to change without notice to you. We may use hyperlinks on the Site which will redirect you to a social network if you click on the respective link. However, when you click on a social plug-in, such as Facebook’s “Like” button, Twitter’s “tweet” button or the Google+, that particular social network’s plugin will be activated and your browser will directly connect to that provider’s servers. If you do not use these buttons none, of your data will be sent to the respective social network’s plugin provider. So for example, when you click on the Facebook’s “Like” button on the Site, Facebook will receive your IP address, the browser version and screen resolution, and the operating system of the device you have used to access the Site. COLLECTION, USE, AND DISCLOSURE OF PERSONALLY-IDENTIFYING INFORMATION WE COLLECT, OR YOU MAY PROVIDE TO US

If you lose control of your account, you should notify us immediately.  GOVERNING LAW; VENUE This Policy is governed by the laws of the State of Michigan and the United States, without giving effect to any conflicts of law principles. We may, in our sole discretion, change this Privacy Policy from time to time. Any and all changes to our Privacy Policy will be reflected on this page and the date new versions are posted will be stated at the top of this Privacy Policy.
